Highsmith vs. Getty Images Case Settles

Apparently, this story has not been widely reported on as of yet. We’re still looking for details on this. As of right now all I know is the case is over with as of Nov 17, 2016 the last PACER Entry states:

STIPULATION OF DISMISSAL WITH PREJUDICE: IT IS HEREBY STIPULATED AND AGREED, by and among the parties, that this action shall be dismissed with prejudice pursuant to Rule 41(a)(l)(A)(ii) of the Federal Rules of Civil Procedure, each party to bear its own costs and fees. (Signed by Judge Jed S. Rakoff on 11/16/2016) (tro) (Entered: 11/17/2016)

Of all of the lawsuits I’ve seen, this is one I really wanted to go the distance but I guess I knew deep down it wouldn’t. The defendants Getty Images, Alamay, and LCS all entered motions to dismiss all counts and were successful on a bunch of them. This may be the reason it was settled. The risk did exist that everything would be dismissed. Too bad so sad. At the very least I hope Getty will be more mindful going forward. Another pipe dream of mine I’m sure.
